I am very interested in making my own SNES or NES game. Is it legal? I know that people do translations all the time but I am interested in actually doing something where I could see a return on the time/money I spend on development without running into legal issues.

If you create your own game with your own sprites, sounds, effects, etc, its legal, that's considered a homebrew.

Completely legal. Return on time/money investment? Not unless you really don't value your time. They make some money, but it's a very niche market.
