"New York woman alleges that gamemakers are responsible for seizures suffered by her infant after playing Spyro: Enter the Dragonfly for the PS2."

Gamespot article

Thoughts?

Dont most or all games come with a warning about epileptic seizures now?

Think the mother will win?

Do you think she is right to sue?

I would think that the warning about epileptic seizures would cover them. But people have sued and won many stupid claims over the years, so it wouldn't suprise me if she won.

It's cases like this that just make me shake my head at some people.  The fact that there is a warning on the game itself that something like this might happen, not to mention the fact that it's not exactly a well guarded secret that this can happen, just makes this a wee bit absurd.  At least she's not asking for a billion gajillion dollars.

Sometimes bad shit happens, and there really isn't anyone to blame.  If the game didn't cause the kid a seizure, then there's a good chance that something else would have in his life.  I would love to hear if he had any prior medical history with seizures.

Videogames don't cause seizures! It's all bad parenting.

It's silly what people sue over these days. There was an ad on tv for a claims solicitor or whatever. They had some old geezer saying how he was given the wrong kind of ladder to do some work on a roof. It slipped and he "badly injured his shoulder", so he was given over £5,000. Then there was a woman who said she fell asleep in the car and when she woke up she realised she had been in an accident. So she got a few thousand.

It really does suck that the kid had a seizure. But there is a WARNING. I hope she doesn't get shit.

Well, if she bought the game used, and the game didn't have a manual, and there was no warning on the game, then she has a case, imo.
